Govt Draft Bill Ends Middlemen in Property Deals

The proposed bill envisions an end-to-end digital property registration process. Under the new framework, homebuyers will be able to register properties using a secure online portal, effectively cutting out multiple visits to government offices and paperwork that, for decades, has been a pain point for Indian homebuyers.

“This reform aims to bring transparency and efficiency to real estate transactions, empowering buyers and reducing their reliance on unregulated agents,” stated a senior official from the Ministry of Housing and Urban Affairs.

Middlemen to Become Redundant

One of the central tenets of the new policy is the elimination of middlemen—real estate agents and third-party brokers who often act as unofficial facilitators during the registration process. By digitizing the entire system, the government aims to reduce avenues for corruption, harassment, and extra-legal fees that frequently plague property transactions.Digital registration will not only save time and costs for buyers but will also drastically reduce fraud and malpractices in the sector,” said Anshuman Magazine, Chairman of CBRE India.

Background: The Need for Reform

A Tangled Web of Paperwork and Broker Fees

For decades, property registration in India has required buyers to navigate a maze of manual paperwork, multiple in-person visits, and reliance on brokers who often charge hefty commissions. According to a 2023 report by Knight Frank, over 60% of urban homebuyers reported facing challenges stemming from unclear paperwork, delays, and non-transparent charges.

The Rising Issue of Fraud and Bottlenecks

Cases of document fraud, fake registration papers, and middlemen exploiting loopholes have been widely reported. These issues not only cause financial losses to buyers but also erode confidence in the real estate sector, estimated to contribute nearly 8% to India’s GDP.

Key Provisions of the Draft Bill

Digital Verification and E-KYC

Under the proposed policy, property buyers and sellers will be required to complete electronic Know Your Customer (e-KYC) processes, leveraging Aadhaar or similar government-issued IDs. All supporting documents can be uploaded digitally, reducing risk of forgery and duplication.

Blockchain-backed Security Measures

A pilot launch of blockchain technology to underpin land records is being considered, with the aim of adding an extra layer of security and transparency to property documents. “Blockchain can create immutable, tamper-proof records, which are crucial for curbing property fraud,” notes Sudeep Narayan, Technical Head at PropTech India.

24×7 Portal Access and Support

The bill mandates the creation of a 24×7 online registration portal, with multilingual support and a helpdesk to assist users unfamiliar with digital processes.

Relief Among Homebuyers

Consumer forums have welcomed the move, anticipating faster transactions and protection from bogus intermediaries. “We urge the government to ensure that every citizen, even those in rural and remote areas, receives proper guidance on using digital services,” said Shweta Tyagi, President of the All India Homebuyers Association.

Concerns from Traditional Agents

On the other hand, traditional real estate agents and brokers have expressed concern about potential job losses and a shrinking role in property transactions. “Middlemen have often helped buyers navigate complex paperwork. The government should involve us in a regulated, value-added capacity,” said Rajesh Sharma, General Secretary, National Association of Realtors (India).

Challenges and the Road Ahead

Digital Divide and Accessibility

Experts warn that the success of the initiative will depend on digital literacy and access to stable internet, especially in semi-urban and rural regions. The government has indicated plans to tie up with state governments and local panchayats to run digital literacy campaigns and set up facilitation centers.

Implementation Timeline

According to ministry officials, the draft bill will be open for public feedback until July 31, 2024. The government anticipates tabling the final bill in Parliament during the Monsoon Session, with phased implementation by early 2025.
