Leading Chinese smartphone manufacturers Oppo and Realme have come under fresh scrutiny from Indian authorities, as tax and regulatory agencies initiate audits to investigate alleged financial irregularities. The probe, which commenced earlier this month, is part of a broader crackdown by Indian regulators on foreign-owned companies operating in the country’s lucrative consumer technology sector.

Audit Launched Over Tax Evasion and Transfer Pricing Concerns

The Directorate General of Goods and Services Tax Intelligence (DGGI) and the Directorate of Revenue Intelligence (DRI) have reportedly launched comprehensive audits targeting Oppo and Realme’s financial transactions and accounting practices in India. According to reports from the Economic Times, the investigations focus on suspected under-invoicing, alleged misreporting of revenues, and potential violations of India’s tax laws.

“The authorities are examining multi-layered transactions between related entities and possible manipulation of transfer pricing,” said an official familiar with the investigations, speaking on condition of anonymity. “Initial findings indicate discrepancies that warrant deeper scrutiny.”

Increasing Regulatory Oversight of Chinese Tech Firms

Oppo and Realme—among the top five smartphone brands in India—hold a significant market share, leveraging the country’s massive demand for affordable, feature-rich mobile devices. However, their prominence has also made them central figures in India’s ongoing reevaluation of Chinese investments and business operations—a process that intensified following geopolitical tensions and allegations of economic non-compliance by several foreign firms.

In recent years, India has stepped up enforcement against smartphone giants for alleged customs duty evasion, non-payment of Goods and Services Tax (GST), and breaches of the Foreign Exchange Management Act (FEMA). Last year, Xiaomi was subject to similar regulatory scrutiny, with the government seizing hundreds of millions in assets related to alleged illegal remittances.

Legal Exposure and Company Responses

Both Oppo and Realme have faced previous inquiries from Indian authorities, but the current audits are more extensive, spanning multiple years of financial filings and cross-border payment records.

In response to queries, Oppo India said, “We are fully cooperating with authorities and are committed to complying with all applicable laws in India.” Realme echoed a similar stance, emphasizing its “dedication to responsible business conduct and lawful operations.”

Financial experts assert that, if proven, the alleged irregularities could carry significant penalties, including steep fines, asset seizures, and potential restrictions on future operations. “The implications are not just fiscal,” noted Anil Bhardwaj, a New Delhi-based tax consultant. “Cases of this nature can dent consumer trust and damage brand equity in a highly competitive market.”

Industry Impact and Political Context

India’s smartphone market, forecasted to exceed 200 million units sold in 2024, has rapidly diversified from domestic brands to foreign players—especially Chinese firms—over the past decade. As regulators tighten the compliance net, global investors and local partners are closely watching the outcome of the audits for signs of policy shifts.

Some industry analysts view the move as part of India’s broader strategy to encourage indigenous manufacturing and reduce dependence on foreign firms with opaque financial practices. “The government is sending a clear message that corporate governance and transparency are non-negotiable,” said Priya Nair, tech industry analyst with Mumbai-based MarketView Research. “This will raise the bar for all multinationals doing business in India.”

Background: Repeated Tensions and Enforcement Actions

The audits of Oppo and Realme are only the latest in a series of enforcement actions targeting Chinese tech firms since 2020, when India banned several Chinese mobile apps over national security concerns and heightened inspections of Chinese investments. While these steps are often justified on legal or regulatory grounds, they also reflect the underlying tension in Sino-Indian relations.

China’s embassy in New Delhi has previously criticized what it describes as discriminatory treatment of Chinese companies, calling for “fair, transparent, and non-discriminatory” enforcement.

The ongoing audits are expected to take several months, as authorities process vast volumes of imported component invoices, royalty payments, and profit repatriation records. Industry insiders believe more companies could soon face similar reviews, especially as India continues to liberalize its economy while asserting stricter oversight of foreign business practices.
